Terms & Conditions

AquaVita Pools
Effective Date: 01 March 2026

These Terms & Conditions apply to all payments made to AquaVita Pools via invoice, secure payment link, bank transfer, or other approved payment method.

By making payment, you agree to the terms outlined below.

1. Quotations & Pricing

1.1 All quotations are valid for 30 days unless otherwise stated in writing.
1.2 Prices are exclusive of VAT unless specified otherwise.
1.3 Quotations are based on the information available at the time of issue and may be subject to revision following site survey or change in specification.

2. Deposits

2.1 A deposit may be required to:

  • Secure a pool unit (Holding Deposit)

  • Secure a site survey appointment (Holding Deposit)

  • Secure a production slot, for bespoke orders (Commitment Deposit)

  • Confirm installation scheduling (Commitment Deposit)

2.2 Holding Deposit for Site Surveys & Stock Reservation

  • Where a deposit is requested prior to a site survey, this will typically be treated as a holding deposit. The purpose of this deposit is to secure the site visit appointment and, where applicable, temporarily reserve an available in-stock pool unit while the site assessment and proposal process is completed.

  • This holding deposit is fully refundable, or if the client chooses to proceed with the project, it will be credited towards the initial project deposit or purchase price.

  • Following the site survey, if either AquaVita Pools or the client decides not to proceed with the project for any reason, the holding deposit will be refunded in full via bank transfer within 14 days of written confirmation and mutual agreement that the project will not proceed.

  • The holding deposit will only become non-refundable if the client cancels the scheduled site survey with less than 48 hours’ notice, except in cases of exceptional or unforeseen circumstances, which may be considered at the discretion of AquaVita Pools.

2.3 Deposit amounts will be clearly stated on the relevant invoice.

2.4 Unless otherwise stated in writing:

  • Deposits for site surveys are refundable.

  • Deposits paid to secure stock or bespoke production may be non-refundable once the pool has been allocated, ordered, or manufacturing has commenced, as per specified terms included on the invoice.

2.5 Where a deposit is refundable, it will be returned via the original payment method within 14 days of written confirmation that the project will not proceed.

3. Stage Payments

3.1 For supply and installation projects, staged payments may be required at agreed milestones.

3.2 Typical stages may include:

  • Refundable Holding Deposit on stock and site survey scheduling

  • Commitment Deposit upon order (less refundable deposit)

  • Payment prior to delivery

  • Payment prior to installation

  • Final balance upon completion

3.3 Payment schedules will be clearly outlined within your quotation or contract.

4. Secure Payment Links

4.1 AquaVita Pools may issue secure payment links tied to specific invoices.

4.2 All online payments are processed via secure third-party payment providers.

4.3 AquaVita Pools does not store or retain full debit or credit card details.

4.4 It is the customer’s responsibility to ensure that payment links are used correctly and only for the specified invoice.

5. Bank Transfers

5.1 Where payment is made by bank transfer, funds must be cleared before:

  • Site Visit is confirmed

  • Stock is released

  • Orders are placed with manufacturers

  • Delivery is scheduled

  • Installation works commence

5.2 AquaVita Pools accepts no responsibility for delays caused by late or incorrectly referenced payments.

6. Cancellations

6.1 Cancellation requests must be made in writing.

6.2 Where cancellation occurs:

  • Prior to stock allocation or bespoke production, refunds may be issued subject to administrative costs.

  • After stock has been allocated, a commitment deposit has been paid or a bespoke order has been placed, deposits may be non-refundable.

  • If installation works have been scheduled, cancellation charges may apply to cover committed labour and materials.

6.3 Any bespoke or special-order pools (including custom colours) are non-refundable once manufacturing has commenced.

7. Delays & Programme

7.1 Delivery and installation timelines are estimates and subject to:

  • Site conditions

  • Weather

  • Third-party contractor availability

  • Material supply

7.2 AquaVita Pools shall not be liable for delays outside of its reasonable control.

8. Installation by Third Parties

8.1 Where customers engage independent builders or contractors, AquaVita Pools is not responsible for:

  • Groundworks

  • Electrical installations

  • Plumbing installations

  • Structural preparation

8.2 Responsibility transfers to the customer or appointed contractor once the pool shell and agreed equipment have been delivered, unless installation is contracted directly through AquaVita Pools.

9. Warranties

9.1 All pool shells are supplied with a 15-year structural warranty (subject to manufacturer terms).

9.2 Equipment warranties (heat pumps, pumps, covers, lighting) are provided in accordance with the relevant manufacturer’s warranty terms.

9.3 Warranties may be void if installation guidelines are not followed.

10. Limitation of Liability

10.1 AquaVita Pools’ liability shall be limited to the value of the goods or services supplied.

10.2 We shall not be liable for indirect, incidental or consequential losses including but not limited to landscaping disruption, loss of use, or project delays caused by third parties.

11. Retention of Title

11.1 All goods remain the property of AquaVita Pools until full payment has been received and cleared.

12. Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
